RICHMOND, Va.--(BUSINESS WIRE)--The Baby Jogger Company(TM), inventor of the original three wheeled jogging stroller and the leading manufacturer of jogging strollers for more than 20 years, today released a statement regarding the trade dress infringement lawsuit filed by B.O.B. Trailers:
David Boardman, CEO of Dynamic Brands, Baby Jogger's parent company, said the following: "We believe the claims in this lawsuit are completely unfounded and we are willing to do whatever it takes in a court of law to vigorously defend ourselves and prevail.
Unfortunately, baseless lawsuits seem to have become simply a part of conducting business in America these days. Often times, when companies can't compete, they decide to sue their competition in the hope the courts will somehow save them. The real loser in all this is consumers, because they're flooded with misinformation which can cause them to make choices they might not otherwise make. That is how we've run all our businesses over the years and the success we've had speaks for itself. If people understood trade dress, they would realize how absurd this case really is."
B.O.B. Trailers alleges that Baby Jogger has copied the appearance and features of the B.O.B.'s Revolution stroller in an attempt to confuse consumers and mislead them into believing that Baby Jogger's All-Terrain Swivel (ATS) is a B.O.B. product. "Nothing could be further from the truth," says Boardman. "In my opinion, not only is the ATS a significantly better value" -- the retail price of the ATS is $299.99, as compared with $359.99 for B.O.B.'s Revolution -- "the ATS has several other key features that distinguish it from the B.O.B. Revolution." These include an Air-Glide suspension system, 5-point safety harness, a formed and padded seat, a molded foot plate, a more aerodynamic canopy for running with side ventilation, push button release rear wheels, and an easy access front wheel locking mechanism -- all innovative features shared by other Baby Jogger products. "Of course," Boardman adds, "the ATS is also prominently marked with the famous Baby Jogger name and trademarked logo, very clearly identifying it as a member of the industry-leading Baby Jogger family -- and not a B.O.B. product."
